Terms & Conditions

These Terms and Conditions govern your use of the Thanya Legal website and the engagement of our pension legal services. We have set them out as plainly as we can. If anything is unclear, please contact us before proceeding.


1. Definitions

For the purposes of these Terms, the following expressions carry the meanings given here wherever they appear:

  • "Agreement" — these Terms and Conditions, together with any engagement letter or service confirmation provided to you.
  • "Content" — all text, documents, materials, and information published on our website or provided in the course of our services.
  • "Services" — the pension legal services offered by Thanya Legal, as described in Section 3 below.
  • "User" / "You" / "Your" — any individual accessing our website or engaging our services.
  • "We" / "Us" / "Our" — Thanya Legal, a legal practice registered and operating in Bangkok, Thailand.
  • "Website" — the website accessible at thanyale.live and its associated pages.

2. Acceptance of Terms

By visiting this website or by engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the website or proceed with engaging us.

To engage our services, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person — for example, a spouse or elderly parent — you confirm that you have authority to do so and that the person on whose behalf you act has been made aware of these Terms.

Agreement is formed when we provide written confirmation of an engagement, whether by email or a signed engagement letter.


3. Service Description

Thanya Legal provides pension legal services to individuals in Thailand. Our three current service levels are:

Initial Pension Consultation — ฿7,400

A confidential first conversation to clarify your pension situation, explain the relevant legal points, and suggest a reasonable way forward. This service does not constitute formal legal representation.

Documentation & Correspondence Service — ฿10,900

Assistance preparing letters, forms, and supporting documents when corresponding with a pension authority or fund. Includes drafting, review, and organised file copies.

Comprehensive Case Representation — ฿13,700

Full support for formal pension matters, including preparation of submissions, liaison with relevant bodies, and representation through to resolution. Terms are discussed and agreed in writing before work begins.

Services are available to individuals located in Thailand. We do not currently offer services to clients outside Thailand, and nothing on this website should be read as an offer to do so.


4. User Responsibilities

When using our website or engaging our services, you agree to:

  • Provide accurate and complete information when contacting us or completing any form.
  • Inform us promptly of any change in your circumstances that is relevant to your matter.
  • Use the website and our services only for lawful purposes.
  • Treat our staff with courtesy and respect in all communications.
  • Not attempt to interfere with, disrupt, or harm the website or its technical infrastructure.
  • Not reproduce, republish, or redistribute any content from our website without written permission.
  • Not submit false or misleading information, documents, or claims as part of any matter we are handling.

The accuracy and completeness of information you provide is your responsibility. We cannot be held liable for outcomes arising from information that was incomplete, inaccurate, or withheld.


5. Intellectual Property

All content on this website — including text, design, layout, and documents — is the property of Thanya Legal or its licensors. All rights are reserved.

You are granted a limited, personal, non-transferable licence to view and access the website for the purpose of considering or using our services. This licence does not extend to copying, publishing, selling, or adapting our content for any other purpose.

Documents prepared by us on your behalf remain our intellectual property until all fees related to that matter have been settled in full, at which point you receive a non-exclusive licence to use those documents for the purpose for which they were prepared.


6. Payment Terms

Fees for each service level are set out in Section 3 and on our website. All amounts are quoted in Thai Baht (฿) and are inclusive of applicable taxes unless otherwise stated.

Payment terms will be confirmed in your engagement letter. For most services, we request a portion of the fee before work begins and the remainder on completion, unless otherwise agreed in writing.

In the event that a matter proves substantially more involved than anticipated, we will discuss any revised fee arrangement with you before proceeding further. We will not increase fees without your prior knowledge and agreement.

Refund policy: If you decide not to proceed after an Initial Pension Consultation has taken place, no refund is available for that service, as the time and professional attention have already been given. For the Documentation Service and Comprehensive Case Representation, where work has not yet commenced, a full refund will be considered; where work is partially completed, fees will be calculated for work performed and any remaining balance returned to you. Disputes about fees should be raised with us in writing in the first instance.

Payment methods accepted are confirmed at time of engagement. We do not store payment card details.


7. Service-Specific Terms

These additional terms apply to our legal services:

  • Scope: The scope of each matter is agreed in writing at the outset. Work outside that scope may require a separate engagement and a revised fee arrangement.
  • Timetable: We work to timetables that are realistic for the matter at hand. We keep you informed of progress and any delays arising from third parties or pension authorities.
  • Confidentiality: All information you share with us is treated with strict confidentiality. We do not share your information with third parties except where necessary to advance your matter, where required by law, or with your express written consent.
  • Your instructions: We act on your instructions. We will advise you if we consider an instruction to be unwise or potentially counterproductive, but the final decision on how to proceed rests with you.
  • Client care: We are required to maintain professional standards and to act in your best interests at all times. If at any point you feel we have fallen short, please raise the matter with us directly.

8. Disclaimers

Information published on this website is provided for general interest only. It does not constitute legal advice and should not be relied upon as such. Pension law is detailed and fact-specific; please contact us directly to discuss your individual situation.

While we take care to keep our website content accurate and up to date, pension regulations can change, and we cannot represent that all information on the website reflects the current position at the precise moment you read it.

We do not make any representation regarding the outcome of any matter we handle. The result of a pension matter depends on the specific facts, the pension authority or fund involved, and factors outside our control. We will advise you honestly about what we consider a reasonable prospect, and we will work carefully on your behalf, but we cannot promise any particular result.


9. Limitation of Liability

To the extent permitted by Thai law, our total liability to you in connection with any service shall not exceed the total fees paid by you for that service.

We shall not be liable for indirect, consequential, or incidental loss, including loss of future pension income, where such loss arises from circumstances outside our reasonable control or from information that was inaccurate or incomplete at the time you provided it.

Nothing in these Terms limits liability for fraud, wilful misconduct, or any matter that cannot lawfully be excluded under the laws of Thailand.


10. Indemnification

You agree to indemnify and hold Thanya Legal harmless from any claims, costs, or losses arising from your breach of these Terms, your misuse of our website, or any false or misleading information you have provided. This obligation survives the ending of any engagement between us.


11. Termination

Either party may end an engagement by giving reasonable written notice. "Reasonable" in this context means sufficient notice to allow an orderly handover of documents and files.

We may end an engagement immediately if you provide us with false or deliberately misleading information, ask us to act in a way that would breach our professional obligations, or engage in conduct that makes it impossible for us to continue acting for you in good conscience.

On ending an engagement, fees will be calculated for work completed to that date. We will return your documents and provide a summary of the matter's status to assist any new adviser you may appoint. Provisions of these Terms that are by their nature continuing — including confidentiality, intellectual property, and limitation of liability — survive termination.


12. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, including the Civil and Commercial Code and applicable consumer protection legislation.

If a concern arises, we ask that you raise it with us in writing in the first instance. We take all concerns seriously and will respond within a reasonable time. Most matters of concern can be resolved through direct and honest communication.

If informal resolution is not possible, disputes shall be subject to the jurisdiction of the courts of Bangkok, Thailand. Mediation may be proposed by either party as an alternative to litigation, and we will consider such proposals in good faith.


13. General Provisions

  • Entire Agreement: These Terms, together with any engagement letter, form the complete agreement between us regarding the subject matter and replace any prior discussions or representations.
  • Severability: If any provision of these Terms is found to be unenforceable under Thai law, the remaining provisions continue in full force.
  • Waiver: A failure by either party to enforce a provision does not constitute a waiver of that provision or the right to enforce it in future.
  • Assignment: You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our obligations to a suitably qualified successor practice, in which case we will notify you.
  • Notices: Written notices under these Terms should be sent by email or by post to the addresses given in Section 15. Notices sent by post are effective three working days after posting.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, the law, or our operating practices. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify existing clients by email.

Continued use of our website or services after updated Terms have been published constitutes acceptance of those updates. If you do not agree to an update, please contact us before your next engagement begins.
